Gift Card Terms & Conditions

1. Introduction
These Gift Card Terms & Conditions ("Terms") govern the purchase, use, redemption and management of gift cards issued by Monarch Avenue OÜ ("Monarch Avenue", "we", "our" or "us").
By purchasing, accepting or redeeming a Monarch Avenue Gift Card, you agree to be bound by these Terms, together with our Terms of Service and any other applicable policies published on our website.
2. Definitions
For the purposes of these Terms:
- Gift Card means a physical or digital gift card issued by Monarch Avenue.
- Purchaser means the person who purchases a Gift Card.
- Recipient means the person who receives or redeems a Gift Card.
- Balance means the remaining monetary value available on a Gift Card.
- Website means the official Monarch Avenue website.
3. Eligibility
Gift Cards may be purchased by individuals aged 18 years or older, or by persons who have the legal capacity to enter into binding contracts under applicable law.
We reserve the right to refuse the sale or redemption of a Gift Card where required by law or where fraudulent or unlawful activity is suspected.
4. Purchasing Gift Cards
Gift Cards may be purchased through our Website in denominations made available at the time of purchase.
Gift Cards may only be purchased using payment methods accepted by Monarch Avenue.
Once payment has been successfully processed, the Gift Card will be issued in accordance with the delivery method selected at checkout.
5. Delivery
Digital Gift Cards will be delivered electronically to the email address provided during purchase.
Physical Gift Cards, where offered, will be delivered to the shipping address provided at checkout.
Delivery times are estimates only and are not guaranteed.
Monarch Avenue is not responsible for delays caused by third-party carriers, internet service providers or circumstances beyond our reasonable control.
6. Redemption
Gift Cards may be redeemed only through the Monarch Avenue Website unless otherwise stated.
Gift Cards may be used towards eligible purchases up to the available balance.
Where the total purchase price exceeds the available Gift Card balance, the remaining amount must be paid using another accepted payment method.
Gift Cards cannot be exchanged for cash.
7. Partial Redemption
Where only part of a Gift Card balance is used, the remaining balance will remain available until the Gift Card expires or the balance is fully redeemed.
8. Balance Enquiries
Customers may check the remaining balance of their Gift Card through the methods made available on our Website or by contacting Customer Support.
9. Expiry
Unless otherwise stated at the time of purchase or where prohibited by applicable law, Monarch Avenue Gift Cards are valid for 36 months from the date of issue.
Any remaining balance after the expiry date will automatically expire and cannot be redeemed, reinstated or refunded.
10. Refunds
Gift Cards are generally non-refundable and cannot be redeemed for cash.
Where a purchase made using a Gift Card is eligible for a refund under our Returns & Refund Policy, any eligible refund will normally be credited back to the original Gift Card or issued as a new Gift Card, unless otherwise required.
If a purchase was made using both a Gift Card and another payment method, refunds will generally be allocated in the same proportions as the original payment.
11. Lost, Stolen or Damaged Gift Cards
Gift Cards should be treated like cash.
Monarch Avenue is not responsible for Gift Cards that are lost, stolen, damaged or used without the holder's permission.
Where technically possible and satisfactory proof of purchase is provided, we may, at our sole discretion, cancel and replace an unused balance. We are under no obligation to do so.
12. Promotional Gift Cards
From time to time, Monarch Avenue may issue promotional or complimentary Gift Cards.
Unless expressly stated otherwise, promotional Gift Cards may be subject to additional conditions, including shorter validity periods, limited redemption options or restrictions on use.
13. Restrictions
Gift Cards may not be:
- resold without our written permission;
- exchanged for cash except where required;
- used for unlawful purposes;
- used to purchase another Gift Card unless expressly permitted;
- altered, copied or reproduced;
- used in any manner intended to circumvent these Terms.
Any attempt to misuse a Gift Card may result in cancellation without notice where permitted by applicable law.
14. Fraud Prevention
Monarch Avenue reserves the right to suspend, cancel or refuse to honour any Gift Card where we reasonably suspect:
- fraud;
- money laundering;
- payment abuse;
- unauthorised use;
- identity theft;
- sanctions violations; or
- any unlawful or prohibited activity.
We may request additional information before activating, replacing or redeeming a Gift Card where reasonably necessary to protect our customers and our business.
15. Limitation of Liability
To the fullest extent permitted by applicable law, Monarch Avenue shall not be liable for indirect, incidental, consequential or special losses arising from the purchase, possession or use of a Gift Card.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
16. Consumer Rights
Nothing in these Terms limits or excludes any mandatory consumer rights that cannot lawfully be excluded under applicable legislation.
Where local consumer protection laws provide greater rights than these Terms, those mandatory rights will prevail.
17. Changes to Gift Card Terms
We may amend these Terms from time to time to reflect changes in our business operations, applicable law or security requirements.
The latest version will always be published on our Website.
Material changes will not affect Gift Cards already purchased to the extent prohibited by applicable law.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Estonia, without prejudice to any mandatory consumer protection rights that may apply in the country where the customer ordinarily resides.
Any disputes shall be subject to the jurisdiction of the competent courts of Estonia unless mandatory law provides otherwise.
